Terms of Use
These Terms of Use (“Terms”) govern access to this proposal website for the Virginia Music Hall of Fame interactive Hall concept. The site is operated by Radio Play Inc. (“Radio Play,” “we,” “us”). By viewing the site you agree to these Terms.
1. What this site is
This website is a confidential pitch companion. It shows concept motion, process, and pricing for discussion. It is not the finished Hall product, not a ticket store, and not an offer that can be accepted by browsing. A paid build starts only if both parties sign a separate statement of work or services agreement.
2. Confidentiality
Pricing, process, videos, stills, copy, and interaction ideas on this site are confidential business information. Do not copy, record, republish, or share them outside the intended client review team without our written consent.
3. Ownership
Radio Play owns the site design, code, motion treatment, and original written materials we created for this pitch. Hall branding, artist names, photographs, CAD drawings, and venue marks belong to their respective owners and appear here only to illustrate a proposed experience. Nothing on this site transfers those rights.
Concept work shown here does not give the client ownership of source files, code, or unused options unless a signed agreement says otherwise.
4. Acceptable use
You may view the site for evaluating the proposal. You may not:
- Scrape, clone, or republish the pages or media.
- Attempt to break, overload, or reverse engineer the site.
- Remove credits, watermarks, or confidentiality notices.
- Use the motion or stills in another pitch or production without a license.
5. Pricing and estimates
Prices shown (including $14,500, $28,500, and $48,000 tiers) are estimates for discussion. They are not a binding quote. Scope, schedule, and payment terms will be set in a signed agreement. Taxes, third-party licenses, stock, music clearances, hardware, and hosting beyond what that agreement lists are extra unless stated.
6. No professional advice
The site is a creative and technical proposal. It is not legal, architectural, accessibility-certification, or financial advice. Production of a public Hall product will require its own contracts, content licenses, and compliance review.
7. Disclaimer
The site is provided “as is.” Videos, hover states, and layouts are demonstrations. We do not warrant uninterrupted access, error-free playback on every device, or that the finished product will match every frame of the pitch. To the fullest extent allowed by law, Radio Play disclaims implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
8. Limitation of liability
To the fullest extent allowed by law, Radio Play is not liable for indirect, incidental, special, consequential, or lost-profit damages arising from use of this pitch site. Our total liability for claims related to this website is limited to one hundred U.S. dollars ($100). This does not limit liability that cannot be limited under applicable law.
9. Third-party services
The site may load fonts, scripts, or video through third parties (for example Google Fonts, Cloudflare, or a JS CDN). Their terms apply to those services.
10. Privacy
How we handle information is described in our Privacy Policy.
11. Changes and termination
We may update these Terms or take the site down at any time. If you do not agree with an update, stop using the site. We may deny access if these Terms are violated.
12. Governing law
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law rules. Courts located in Virginia have exclusive jurisdiction, except that we may seek injunctive relief in any venue to protect confidential materials or intellectual property.
